Terms of service
General Terms & Usage
If a permission, feature, or allowance is not explicitly stated here, do not assume it is permitted. If anything is unclear or you require clarification, you must submit a question through my Discord ticket system before proceeding.
These products are intended exclusively for use for VTubing and VRChat.
Purchases made for any other software, platform, or purpose are not permitted unless you have received prior written approval from me. If you intend to use the product outside of VTubing or VRChat (including but not limited to other games, engines, or commercial applications), you must contact me in advance to discuss eligibility and pricing.
Unauthorized use outside the approved scope may result in revoked access, denial of support, or other corrective action.
Avatar License Terms
1. Account Information & Verification
You must provide accurate checkout information, including your Discord username and VRChat username. This information is used to associate the license with a single account and to prevent unauthorized redistribution or potential DMCA violations.
Providing false or incomplete information may result in denied access or revoked licensing.
2. Permitted Use
Avatars are licensed for personal use only unless otherwise approved in writing.
You may upload the avatar to your own primary or alternate accounts for personal use.
You may create and sell original content or add-ons specifically designed to fit Xero 3D models, provided no base assets are redistributed.
You may use the avatar for streaming, video creation, photography, and social media with proper credit provided at all times.
3. Attribution Requirements
Credit is mandatory whenever Xero 3D models are used, including but not limited to:
Streams
Videos
Promotional material
Photography
Monetized content
Credit must clearly reference Xero 3D and include a link to the official shop when applicable.
Claiming the model as your own, removing watermarks, or failing to provide credit is considered a violation and may result in DMCA action.
4. Prohibited Use
The following actions are strictly prohibited:
Reselling, redistributing, sharing, or leaking any avatar files or packages.
Public uploads of any avatar.
Uploading avatars to another person’s account unless both parties own a valid license for the same avatar.
Price splitting or sharing purchases.
Making modified or derived public versions of the avatar.
Creating derivative concepts or replicas of Xero 3D models without permission (plagiarism).
Removing watermarks or claiming ownership of Xero 3D models.
Any unauthorized distribution or public upload will result in immediate revocation of access and a permanent ban from the store and associated platforms.
5. Gifting & Shared Licenses
Packages may not be shared.
Gifting must be completed using the official gift card system or when the information of the recipient is filled out in checkout (they will receive an email to the download, so you shouldn't have to share it with them) This doesn't mean you have rights to the avatar, only the gift recipient has rights to the package.
6. Commissions
For commissioned work involving Xero 3D avatars:
Both the commissioner and the artist must own a valid license for the same avatar.
Proof of purchase must be provided upon request.
7. Refunds & Technical Responsibility
All sales are final. No refunds, chargebacks, or disputes are permitted for digital products.
Basic Unity knowledge is expected prior to purchase.
Xero 3D is not responsible for platform updates, compatibility issues, or customer-made edits.
8. Enforcement
Users banned from the Discord server are prohibited from purchasing.
Leaking or unauthorized distribution will result in permanent bans and license termination.
Unauthorized versions should be reported immediately.
Asset License Terms
1. Account Information & Verification
Accurate checkout information (Discord and applicable platform usernames) is required to attach the license to your account and prevent misuse or DMCA violations.
2. Permitted Use
Assets may be used for personal or commercial projects for VRChat or VTubing, unless otherwise stated.
Assets may be edited and modified.
Assets must only be used in finished products (models or avatars for VRChat or VTubing if commercial).
Assets may be used in other platforms or games for personal use only unless permitted by Xero 3D.
Selling textures created for Xero 3D assets (such as bases or heads) is permitted.
Assets must be purchased directly from authorized sources prior to use.
3. Public & Free Model Usage
Assets may not be used on public or free models without prior written permission via Discord.
Free assets provided directly by Xero 3D are exempt from this restriction.
4. Attribution Requirements
Credit must be displayed on your store page when assets are used commercially.
Credit must include Xero 3D’s name and a clickable hyperlink to the official shop.
5. Prohibited Use
The following actions are strictly prohibited:
Redistribution, sharing, or leaking of assets.
Reselling individual mesh parts or textures.
Claiming assets as your own.
Using assets on public/free models without permission.
Allowing unlicensed users access to the assets.
6. Commissions
For commission-based projects:
Both parties must own a valid license for the same asset(s).
7. Refunds & Technical Responsibility
All sales are final. No refunds, chargebacks, or disputes are permitted.
Basic Blender knowledge is expected prior to purchase.
8. Enforcement
Individuals banned from the Discord server may not purchase.
Leaking products will result in immediate revocation of access and permanent banning.
Legal Agreement
By purchasing any Xero 3D model or asset, you acknowledge that you have read, understood, and agreed to all terms listed above. Failure to comply may result in enforcement action under the Digital Millennium Copyright Act (DMCA) and permanent revocation of licensing rights.
